TERMS OF SERVICE — English Version

1. Acceptance of Terms
By accessing or using the services provided by Eteriux Solutions (hereinafter “Eteriux”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.
These Terms apply to all users of the platform, including end users, businesses, and any third party that accesses the service through our platform.
2. Description of Services
Eteriux Solutions provides an intelligent chatbot management and automation platform accessible through our web interface. Our services include, but are not limited to:
- Creation and configuration of automated conversational flows
- Customer lead capture and management
- Multi-channel messaging automation
- Integration with third-party platforms and APIs
- Real-time analytics and performance dashboards
- Technical support and platform maintenance
Eteriux reserves the right to modify, suspend, or discontinue any part of the service at any time, with or without prior notice.
3. User Accounts and Registration
To access certain features of our platform, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
Eteriux reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. Acceptable Use
You agree not to use the platform to:
- Send unsolicited, abusive, misleading, or illegal messages
- Violate any applicable local, national, or international law or regulation
- Infringe upon the intellectual property rights of any third party
- Distribute malware, spam, or any harmful content
- Attempt to gain unauthorized access to any part of the platform or its related systems
- Impersonate any person or entity or misrepresent your affiliation
Violation of acceptable use policies may result in immediate account suspension or termination without prior notice.
5. Intellectual Property
All content, features, and functionality available through the Eteriux platform — including but not limited to software, text, graphics, logos, icons, and data compilations — are the exclusive property of Eteriux Solutions and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for its intended purpose. You may not copy, reproduce, distribute, modify, or create derivative works of any part of the platform without express written consent from Eteriux.
6. Privacy and Data Protection
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, processing, and use of your data as described in the Privacy Policy available at eteriux.com/politica-privacidad.
We comply with applicable Colombian data protection law (Law 1581 of 2012 and Decree 1377 of 2013) and take reasonable technical and organizational measures to protect your information.
7. Service Availability and Uptime
Eteriux strives to maintain high availability of its platform. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance, updates, or unforeseen technical issues may cause temporary downtime.
Eteriux shall not be liable for any loss or damage resulting from service interruptions beyond our reasonable control, including force majeure events, third-party infrastructure failures, or telecommunications outages.
8. Fees and Payment
Certain services offered by Eteriux may be subject to fees as agreed in a separate commercial contract or subscription plan. All fees are non-refundable unless otherwise specified in writing.
Eteriux reserves the right to modify pricing at any time. Users will be notified of any price changes with reasonable advance notice through the platform or by email.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Eteriux Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising from your use of or inability to use the services.
In no event shall Eteriux’s total liability exceed the amount paid by you for the services during the three (3) months prior to the event giving rise to the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Eteriux Solutions, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the platform, your violation of these Terms, or your violation of any rights of a third party.
11. Modifications to Terms
Eteriux reserves the right to update or modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform and updating the effective date. Continued use of the service after such changes constitutes your acceptance of the new Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the city of Bogotá, Colombia.

1. Aceptación de los Términos
Al acceder o utilizar los servicios proporcionados por Eteriux Solutions (en adelante “Eteriux”, “nosotros” o “nuestro”), usted acepta quedar vinculado por estos Términos de Servicio (“Términos”). Si no está de acuerdo con estos Términos, por favor no utilice nuestros servicios.
Estos Términos aplican a todos los usuarios de la plataforma, incluyendo usuarios finales, empresas y cualquier tercero que acceda al servicio a través de nuestra plataforma.
2. Descripción de los Servicios
Eteriux Solutions proporciona una plataforma de gestión y automatización de chatbots inteligentes accesible a través de nuestra interfaz web. Nuestros servicios incluyen, entre otros:
- Creación y configuración de flujos conversacionales automatizados
- Captura y gestión de clientes potenciales
- Automatización de mensajería multicanal
- Integración con plataformas y APIs de terceros
- Análisis en tiempo real y paneles de rendimiento
- Soporte técnico y mantenimiento de la plataforma
Eteriux se reserva el derecho de modificar, suspender o descontinuar cualquier parte del servicio en cualquier momento, con o sin previo aviso.
3. Cuentas de Usuario y Registro
Para acceder a ciertas funcionalidades de nuestra plataforma, puede ser necesario crear una cuenta. Usted se compromete a:
- Proporcionar información precisa, actual y completa durante el registro
- Mantener la confidencialidad de las credenciales de su cuenta
- Notificarnos de inmediato ante cualquier uso no autorizado de su cuenta
- Asumir la responsabilidad de todas las actividades realizadas bajo su cuenta
Eteriux se reserva el derecho de suspender o cancelar cuentas que infrinjan estos Términos o que incurran en actividades fraudulentas, abusivas o ilegales.
4. Uso Aceptable
Usted se compromete a no utilizar la plataforma para:
- Enviar mensajes no solicitados, abusivos, engañosos o ilegales
- Violar cualquier ley o regulación local, nacional o internacional aplicable
- Infringir los derechos de propiedad intelectual de terceros
- Distribuir malware, spam o cualquier contenido dañino
- Intentar acceder de forma no autorizada a cualquier parte de la plataforma o sus sistemas relacionados
- Suplantar la identidad de cualquier persona o entidad
La violación de las políticas de uso aceptable puede resultar en la suspensión o cancelación inmediata de la cuenta sin previo aviso.
5. Propiedad Intelectual
Todo el contenido, las funcionalidades y la información disponible a través de la plataforma de Eteriux — incluyendo, entre otros, software, textos, gráficos, logotipos, íconos y compilaciones de datos — son propiedad exclusiva de Eteriux Solutions y están protegidos por las leyes de propiedad intelectual aplicables.
Se le otorga una licencia limitada, no exclusiva e intransferible para acceder y utilizar la plataforma únicamente para sus fines previstos. No podrá copiar, reproducir, distribuir, modificar ni crear obras derivadas de ninguna parte de la plataforma sin el consentimiento expreso y por escrito de Eteriux.
6. Privacidad y Protección de Datos
El uso de la plataforma también se rige por nuestra Política de Privacidad, que se incorpora a estos Términos por referencia. Al utilizar nuestros servicios, usted consiente la recolección, tratamiento y uso de sus datos tal como se describe en la Política de Privacidad disponible en eteriux.com/politica-privacidad.
Cumplimos con la normativa colombiana de protección de datos personales (Ley 1581 de 2012 y Decreto 1377 de 2013) y adoptamos medidas técnicas y organizativas razonables para proteger su información.
7. Disponibilidad del Servicio
Eteriux se esfuerza por mantener una alta disponibilidad de su plataforma. Sin embargo, no garantizamos un servicio ininterrumpido o libre de errores. El mantenimiento programado, las actualizaciones o problemas técnicos imprevistos pueden causar interrupciones temporales.
Eteriux no será responsable por pérdidas o daños resultantes de interrupciones del servicio fuera de nuestro control razonable, incluyendo eventos de fuerza mayor, fallos en la infraestructura de terceros o interrupciones en las telecomunicaciones.
8. Tarifas y Pagos
Ciertos servicios ofrecidos por Eteriux pueden estar sujetos a tarifas acordadas en un contrato comercial separado o plan de suscripción. Todas las tarifas son no reembolsables, salvo que se especifique lo contrario por escrito.
Eteriux se reserva el derecho de modificar los precios en cualquier momento. Los usuarios serán notificados de cualquier cambio de precio con un aviso previo razonable a través de la plataforma o por correo electrónico.
9. Limitación de Responsabilidad
En la máxima medida permitida por la ley aplicable, Eteriux Solutions no será responsable por daños indirectos, incidentales, especiales, consecuentes o punitivos, incluyendo pérdida de beneficios, datos, reputación comercial o interrupción del negocio, derivados del uso o la imposibilidad de uso de los servicios.
En ningún caso la responsabilidad total de Eteriux superará el monto pagado por usted por los servicios durante los tres (3) meses anteriores al evento que dio origen a la reclamación.
10. Indemnización
Usted se compromete a defender, indemnizar y mantener indemne a Eteriux Solutions, sus directivos, empleados y agentes frente a cualquier reclamación, responsabilidad, daño, pérdida o gasto, incluidos honorarios legales razonables, que surjan de su uso de la plataforma, del incumplimiento de estos Términos o de la violación de los derechos de un tercero.
11. Modificaciones a los Términos
Eteriux se reserva el derecho de actualizar o modificar estos Términos en cualquier momento. Notificaremos a los usuarios sobre cambios sustanciales publicando los Términos actualizados en la plataforma y actualizando la fecha de vigencia. El uso continuado del servicio tras dichos cambios constituye su aceptación de los nuevos Términos.
12. Ley Aplicable y Resolución de Disputas
Estos Términos se regirán e interpretarán de conformidad con las leyes de la República de Colombia. Cualquier disputa que surja en virtud de o en relación con estos Términos estará sujeta a la jurisdicción exclusiva de los tribunales competentes de la ciudad de Bogotá, Colombia.
